This article consists of five sections: the first, which as an introduction will refer to the location and geo-political context of the community of Santa Fe de la Laguna; the second will address the regulatory recognition that has influenced the judicialization and implementation of indigenous rights to self-determination, autonomy and self-government in Michoacán; the third will focus on the political-legal process of Santa Fe de la Laguna for the conquest of its right to self-government and for the exercise of the direct budget; in the fourth section, a series of arguments will be proposed as a conclusion that invite reflection on legal pluralism as a space of creation and normative application in which different epistemologies are articulated, among them, those that come from the indigenous peoples and communities, whose positions fight in favor of the construction of a plurinational state; finally, the sources of information are presented.</p> Beatriz Esquivel Contreras Copyright (c) 2024 Universidad Nacional Autónoma de México https://creativecommons.org/licenses/by-nc-nd/4.0 https://revistas.juridicas.unam.mx/index.php/derecho-electoral/article/view/18752 Wed, 13 Nov 2024 00:00:00 +0000 The performance of local EMBs as a result of their general councils’ integration: an empirical study from the electoral governance in Mexico https://revistas.juridicas.unam.mx/index.php/derecho-electoral/article/view/18959 <p class="p1">Since the 2014 reform to the Mexican constitution, the INE has appointed 502 members for 32 local EMBs’ general councils. Naturally, these profiles are heterogeneous and, consequently, through their decisions, they asymmetrically influence political-electoral rights and democracy itself. The purpose of this paper is to find out what profile traits should be considered to appoint members of the local EMBs’ general councils, in order to achieve a better performance. A mixed methodology is adopted for this study by analyzing 502 local councilors in the period 2014-2023, in addition six case studies are analyzed. For this purpose, through this research we seek, at first, to describe the national context in which local political parties compete against national political parties and the possibility of not only maintaining the registry but also being an actor with possibilities. Likewise, in a second moment, it is intended to analyze the local partisan context of the State of Hidalgo, since in 2018 the first two local political parties were formed and in 2019, derived from the loss of the national registration of two political parties, two new ones were added. Electoral observers have the role of safeguarding the rights to political participation, liberty and personal security, liberty of movement, access to justice, freedom of opinion and expression, freedom of association with others, peaceful assembly, and equality before the law. Given their work in defense of the rights established in the Inter-American System and the Universal System, they are key actors in the defense of democracy. Observers are victims of violence and intimidation, a situation that has increased in recent years as a result of the growing polarization, misinformation, and intolerance that characterizes electoral processes. For this reason, electoral observers must have effective protection mechanisms. Their designation as human rights defenders by the United Nations Special Rapporteurs for Human Rights is a step in the right direction, but it should not be the last.
