The Vindication of the Rights of Article 35, Fraction Ii, of People Belonging to the Lgbttti Community and People With Disabilities In Aguascalientes

Abstract

This text analyzes the situation of persons belonging to the LGBTTTIQ+ community and persons with disabilities, with respect to the right to be elected in the state of Aguascalientes. It shows that despite the efforts made by administrative and jurisdictional authorities in electoral matters, there is no real substantive equality that allows people who are part of these groups to truly exercise this right. However, in accordance with the principle of progressiveness and affirmative actions, there is evidence that gradual progress has been made.
Therefore, the normative and pragmatic context of these groups is shown, along with an account of their modification based on the socio-legal movements that have made it possible to open the gap to achieving the effective enjoyment of the right to vote, and finally, based on an evolutionary study of the information of those persons who self-identify as members of these groups who have served as popular representatives, particularly since 2021, to analyze the prospects for their inclusion by the different political forces, when selecting candidates for an election.
