La doctrina de las “manos limpias” (clean hands): entre consagraciones fallidas y escenarios de desjudicialización en el orden jurídico internacional

Resumen

El artículo analiza la doctrina de las “manos limpias” en el derecho internacional y su impacto en el campo de las objeciones procesales. La ubicación de esta doctrina en las fuentes de derecho, y en especial como principio general del derecho del artículo 38 del Estatuto de la CIJ, se discute en este trabajo. Es un aspecto relacionado con los contextos normativos y conceptuales de esta institución, y su relación con otros principios y máximas derivadas del principio de equidad y de buena fe. De modo enfático, se argumenta el impacto de la operatividad de esta doctrina en la estructuración e institucionalización de la sociedad internacional, cuando podría impedir la jurisdicción de un tribunal internacional o la admisibilidad de una reclamación internacional para resolver una disputa en las relaciones interestatales.
