El derecho a la libre determinación de los pueblos frente a la institucionalización de la democracia: implicaciones políticas y jurídicas de la consulta de Guatemala ante la Corte Interamericana de Derechos Humanos
Este artículo analiza el alcance del derecho a la libre determinación de los pueblos y las tensiones que surgen a la luz de la solicitud de Opinión Consultiva presentada por Guatemala ante la Corte Interamericana de Derechos Humanos sobre el derecho humano a la democracia. El artículo considera que la propuesta de Guatemala se basa en fuentes legales insuficientes (instrumentos de soft law y obiter dicta de diversos casos), por lo que examina si el derecho a la libre determinación de los pueblos podría interpretarse en esos términos. Se examina la intención deliberada de excluir un derecho a la democracia debido a la falta de consenso internacional en torno a su definición. Además, se destacan otros desafíos políticos y jurídicos que la Corte debería considerar en su pronunciamiento, como la imposición de una definición controvertida, la creación de un derecho regional que no cuenta con respaldo en el derecho internacional de los derechos humanos y el descuido de las prácticas subyacentes necesarias para un régimen democrático sano y funcional.
