De la libertad al deber: discurso gubernamental y principio de responsabilidad comunicativa

Resumen

Este artículo examina los límites constitucionales del discurso gubernamental a partir de una concepción estructural de la libertad de expresión, según la cual esta es una garantía institucional de la simetría deliberativa del espacio público. El trabajo argumenta que la expresión de los funcionarios públicos debe estar sujeta a deberes reforzados, derivados de su posición estructuralmente asimétrica en el debate público. Para ello, se analiza la doctrina del government speech y el test funcional desarrollado por la Suprema Corte de Estados Unidos, así como los estándares del derecho comparado y del derecho internacional de los derechos humanos. Se muestra cómo, en contextos populistas, el espacio público puede ser objeto de una doble captura: (1) la apropiación institucional de recursos y canales oficiales y, (2) la interacción estratégica con las redes sociales. Finalmente, propone el principio de responsabilidad comunicativa como marco normativo orientado a preservar la igualdad deliberativa y el pluralismo democrático.
